By accessing or using the services provided by Sun Data Nexus ("we," "us," "our," or "the Company"), including our website, data marketplace, direct mail platform, and subscription feeds, you ("the Customer," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our services or place any orders. Your agreement is confirmed each time you check the acceptance box at checkout.
Sun Data Nexus provides business intelligence data products derived from public records, including but not limited to Florida corporation filings, professional licensee directories, contractor registrations, and related datasets. Our services include:
Delivery Timeline: Most data orders are scrubbed, verified, and delivered to your email with a secure download link within 24 hours of payment. Real estate licensee and appraiser datasets that already include email addresses may be delivered sooner. Direct mail orders are queued for design review before being sent to print.
All data is sourced from publicly available government records and third-party databases. While we make reasonable efforts to provide accurate and current information, we do not guarantee the completeness, accuracy, timeliness, or reliability of any data delivered.
Data is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Public records may contain errors, omissions, or outdated information that we cannot control or correct.
Mailing addresses included in our datasets are not guaranteed to be deliverable. We apply domestic (U.S.) address filtering to remove non-deliverable entries, but undeliverable mail may still occur. We are not liable for postage spent on undeliverable addresses.

When you purchase direct mail services, Sun Data Nexus acts as your agent in coordinating the design, printing, and mailing of postcards, notecards, or letters through our printing and mailing partners. You acknowledge that:
All orders are processed through Stripe secure payment processing. Prices are listed in U.S. dollars. Data product pricing is based on record counts and selected parameters at the time of checkout. Direct mail pricing includes printing, postage, and a service markup. Subscription fees are billed on a recurring monthly basis until canceled.
Applicable sales tax may be collected based on your billing address and our tax nexus obligations.
Data exports: Because data products are digital goods, they are generally non-refundable once the download link has been accessed. Orders are scrubbed and verified before delivery (typically within 24 hours). If you receive materially defective data (e.g., empty file, wrong dataset), contact us within 7 days for a replacement or refund at our discretion.
Direct mail orders: Once mail has been submitted to our printing and mailing partner, it cannot be canceled or refunded. If mail fails to send due to a system error on our end, we will re-send at no additional cost or issue a refund for the affected portion.
Subscriptions: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused days within a billing cycle.
Sun Data Nexus retains all rights, title, and interest in our platform, branding, proprietary data processing methods, and compiled datasets (as compilations). You retain ownership of your mailer designs, logos, and marketing content uploaded to our platform. Individual public records are not owned by any party; however, our compilation, formatting, and enhancement of those records constitutes a protected database under applicable law.
To the maximum extent permitted by law, Sun Data Nexus, its officers, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of business, loss of goodwill, loss of data, or costs of procurement of substitute goods or services, arising out of or related to your use of our services.
Our total aggregate liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to Sun Data Nexus for the specific product or service giving rise to the claim in the preceding twelve (12) months.
You agree to indemnify, defend, and hold harmless Sun Data Nexus and its affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your misuse of the data, violation of these Terms, violation of applicable laws (including TCPA, CAN-SPAM, or FCRA), or infringement of any third-party rights through your marketing campaigns or business activities.
We collect and process personal information as described in our Privacy Policy. By using our services, you consent to our data practices. Customer email addresses and billing information are stored securely and used for order fulfillment, support, and account management.
While our platform does not require login for checkout, certain features (such as order history, saved mailing lists, and profile management) require account registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
We reserve the right to suspend or terminate your access to our services at any time, with or without cause or notice, if we believe you have violated these Terms or applicable law. Upon termination, your right to use the services ceases immediately. Provisions that by their nature should survive termination (including ownership, disclaimers, indemnification, and limitation of liability) shall remain in effect.
We may update these Terms at any time. When material changes are made, we will update the "Last updated" date at the top of this page. Your continued use of our services after changes take effect constitutes acceptance of the revised Terms. The version of the Terms you agreed to at checkout is recorded with your order for legal traceability.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be resolved in the state or federal courts located in Florida.
